Swaytype Terms of Service
1. Acceptance
By using Swaytype you agree to these Terms. If you do not agree, do not use the app.
You must be at least 13 years old to use Swaytype. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed these Terms.
2. What Swaytype does
Swaytype is an iOS keyboard that rewrites short messages into different tones (Casual, Flirt, Professional). The rewrite is generated by OpenAI’s models, called from our server. Swaytype does not draft messages on its own. It rewrites text you have already typed and selected.
3. Your account
You sign in with Apple. You are responsible for keeping your Apple ID secure. You can delete your account at any time from Settings inside the app.
You may not create an account on behalf of someone else, share your account, or use the service in a way that violates the App Store Terms of Service.
4. Subscriptions
Swaytype is free to use within a daily quota. Paid tiers remove the quota:
- Monthly subscription. Auto-renewable, billed monthly.
- Yearly subscription. Auto-renewable, billed yearly.
- Lifetime. One-time purchase, no renewal.
How auto-renewable subscriptions work
- Payment is charged to your Apple ID at confirmation of purchase.
- Your subscription renews automatically at the end of each billing period at the price shown in the app, unless you cancel at least 24 hours before the period ends.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription at any time from Settings > Subscription > Manage Subscription, which opens your Apple ID subscription page. Auto-renewal can be turned off there.
- Cancelling stops the next renewal but does not refund the current period.
Refunds
All refunds are handled by Apple under their standard refund policy. Request a refund at reportaproblem.apple.com.
Price changes
If we change the subscription price, we will notify you in advance through the app and you will be able to cancel before the new price takes effect.
5. Acceptable use
You may not use Swaytype to:
- Generate content that violates the law or another person’s rights.
- Harass, threaten, or impersonate another person.
- Reverse-engineer the app, scrape the API, or attempt to bypass quota or paywall.
- Use the service to train another AI model.
We may suspend or terminate accounts that violate these rules.
6. Your content
You keep all rights to the text you type and the rewrites you receive. By using the service you give us a limited licence to process your text for the purpose of generating the rewrite, as described in the Privacy Policy.
If you opt in to “Help improve Swaytype” in Settings, you also give us a licence to keep the original text and the rewrite for up to 365 days, in order to improve our prompts. You can revoke this at any time and delete your stored samples from Settings.
7. Intellectual property
The Swaytype app, brand, logo, and prompts are the property of Enrico Carrasco Network. You may not copy, redistribute, or create derivative apps without written permission.
The rewrites are generated by OpenAI’s models. The output may resemble output produced for other users from similar input. We make no claim of exclusivity over any individual rewrite.
8. Disclaimer
Swaytype is provided “as is.” The rewrites are generated by an AI model and may contain errors, awkward phrasing, or content you did not intend. Always read the rewrite before sending it. We do not guarantee that the rewrites are accurate, appropriate, or fit for any particular purpose.
To the maximum extent permitted by Dutch law, Enrico Carrasco Network is not liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these Terms limits liability that cannot be limited by Dutch law (including liability for intent or gross negligence).
9. Termination
You may stop using Swaytype and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we are legally required to.
If your account is terminated, your right to use the app ends. Active subscriptions remain valid until the end of the paid period and will not auto-renew.
10. Governing law
These Terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved by contacting us first will be submitted to the competent court in the Netherlands.
If you are a consumer resident in the European Union, mandatory consumer protection laws of your country of residence still apply.
11. Changes to these Terms
We may update these Terms. The effective date at the top of the page reflects the latest version. Material changes will be announced inside the app on next launch. Continued use of the app after a change means you accept the new Terms.
