Swaytype Terms of Service
1. Acceptance
By using Swaytype you agree to these Terms. If you do not agree, do not use the app.
You must be at least 13 years old to use Swaytype. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed these Terms.
2. What Swaytype does
Swaytype is a keyboard app for iPhone and Android, available on the App Store and Google Play. It rewrites your messages in a different tone (Casual or Professional) and translates them into other languages (Translate). It can also translate a message you receive: copy it, tap the translate button in the keyboard, and Swaytype shows you the translation.
On iPhone, Mates lets two people who accepted each other’s invite leave short notes for each other. The notes show in the app and on the Swaytype widget, translated into the reader’s language when needed.
Rewrites and translations are written by Anthropic and OpenAI
Every rewrite and translation is written by AI models from two outside companies, called from our server: Claude, from Anthropic, and OpenAI’s models. When you tap Improve or Translate, in the keyboard or in the app, Swaytype sends the text you chose through our server to one of them, and that model writes the result. If it fails or does not answer in time, our server sends the same text to the other one, and it writes the result instead. Swaytype does not write messages on its own. It works on text you have already typed, or on a message you copied to translate.
By continuing past setup and by using Improve or Translate, you agree that the text you choose is sent to Anthropic or OpenAI to write the result. If you do not agree, do not use Improve or Translate. Anthropic’s commercial terms state that it may not train its models on this text, and OpenAI’s API terms state that it is not used to train its models by default. Our Privacy Policy explains what is sent and what we keep.
3. Your account
When you first open Swaytype, we create an anonymous account for you. It has no name, email or password. If you turn on “Sync across devices” in Settings, you can link it to Sign in with Apple (on iPhone) or Google (on Android) to keep the same account on all your devices. You are responsible for keeping your device and your Apple or Google account secure.
You can delete your account at any time from Settings inside the app, or by email as described on swaytype.com/delete-account.
You may not create an account on behalf of someone else, share your account, or use the service in a way that violates the App Store or Google Play terms.
4. Subscriptions
Swaytype is free to use with 10 rewrites or translations every 24 hours. Paid plans remove that daily limit:
- Pro Monthly. Auto-renewable, billed monthly.
- Pro Yearly. Auto-renewable, billed yearly. It starts with a 7-day free trial if your Apple or Google account is eligible for it.
- Lifetime. One-time purchase, no renewal.
To prevent abuse, paid plans still have a high fair-use limit.
How auto-renewable subscriptions work
- You buy and pay through the store you downloaded Swaytype from: the Apple App Store on iPhone or Google Play on Android. We process purchases through RevenueCat and never see your card or bank details.
- Payment is charged to your Apple Account or Google Play account when you confirm the purchase. If you start the free trial, the first yearly payment is charged when the trial ends, unless you cancel before then.
- Your subscription renews automatically at the end of each billing period at the price shown in the app, until you cancel it in your App Store or Google Play subscription settings.
- On iPhone, cancel at least 24 hours before the current period (or trial) ends to avoid the next charge. Apple charges the renewal within the 24 hours before the current period ends.
- You can manage or cancel your subscription at any time, and turn off auto-renewal, in the store’s settings. On iPhone: iOS Settings > your name > Subscriptions. On Android: the Play Store app > your profile picture > Payments and subscriptions > Subscriptions.
- Cancelling stops the next renewal but does not refund the current period.
- Deleting your Swaytype account does not cancel a subscription. Cancel it in the store as well so you are not charged again.
Refunds
Refunds follow the refund policy of the store you paid through. On iPhone, request a refund from Apple at reportaproblem.apple.com. On Android, see Google Play’s refund policies.
Price changes
If we change the subscription price, we will notify you in advance through the app and you will be able to cancel before the new price takes effect.
5. Acceptable use
You may not use Swaytype to:
- Generate content that violates the law or another person’s rights.
- Harass, threaten, or impersonate another person.
- Reverse-engineer the app, scrape the API, or attempt to bypass quota or paywall.
- Use the service to train another AI model.
We may suspend or terminate accounts that violate these rules.
Mates
Your Mates name, photo and notes must follow the rules above. Don’t send spam, sexual content, hate, threats or anything meant to hurt someone, and only invite people who want to hear from you.
- We check names, photos and notes with an automatic filter before we save them and refuse what it flags. The filter can make mistakes both ways.
- You can remove or block a mate, and report a note, at any time in the app. We look at every report.
- We may delete notes, photos or names, and end someone’s access to Mates, when they break these rules.
6. Your content
You keep all rights to the text you type and the rewrites and translations you receive. By using the service you give us a limited licence to process your text for the purpose of generating the rewrite or translation, as described in the Privacy Policy.
If you opt in to “Help improve Swaytype” during setup or in Settings, you also give us a licence to keep the text you sent, the rewrite we returned, and the final text after any edits you made, for up to 365 days, in order to improve the rewrites. You can revoke this at any time and delete your stored samples from Settings.
When you use Mates, you give us a licence to store your name, photo and notes, to check them with the filter, to translate your notes and to show them to your mates. We keep notes for 30 days, as described in the Privacy Policy.
7. Intellectual property
The Swaytype app, brand, logo, and prompts are the property of Enrico Carrasco Network. You may not copy, redistribute, or create derivative apps without written permission.
The rewrites and translations are generated by Anthropic’s or OpenAI’s models. The output may resemble output produced for other users from similar input. We make no claim of exclusivity over any individual rewrite or translation.
8. Disclaimer
Swaytype is provided “as is.” The rewrites and translations are generated by an AI model and may contain errors, awkward phrasing, or content you did not intend. Always read the result before sending it. We do not guarantee that the rewrites or translations are accurate, appropriate, or fit for any particular purpose.
To the maximum extent permitted by Dutch law, Enrico Carrasco Network is not liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these Terms limits liability that cannot be limited by Dutch law (including liability for intent or gross negligence).
9. Termination
You may stop using Swaytype and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we are legally required to.
If your account is terminated, your right to use the app ends. A subscription stays active in the App Store or Google Play until you cancel it there, because Apple and Google handle billing. Deleting or terminating your Swaytype account does not cancel it.
10. Governing law
These Terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved by contacting us first will be submitted to the competent court in the Netherlands.
If you are a consumer resident in the European Union, mandatory consumer protection laws of your country of residence still apply.
11. Changes to these Terms
We may update these Terms. The date at the top of the page shows the latest version. Material changes will be announced inside the app on next launch. Continued use of the app after a change means you accept the new Terms.
